Car Owner Furious over No Compensation for Accident Caused by Delivery Service’s Rock on Highway

The Honda City suffered extensive damage when it collided with a large rock that had fallen off a truck belonging to a shipping company on the Hanoi - Ninh Binh highway.

A Honda City owner had an unexpected accident while driving on the Hanoi – Ninh Binh expressway. However, the subsequent developments of the story have made many people more disgusted with the consciousness of many drivers and the responsibility of the parties involved.

The accident of the Honda City

Mr. Luong Quan Chung, the owner of a Honda City car, said that on the evening of April 16, 2023, he was driving on the Hanoi – Ninh Binh expressway, in the area of Ha Nam province, when he suddenly saw a fairly large obstacle in front of the car. Due to the dark sky and the headlights of an oncoming car, Mr. Chung couldn’t steer in time and collided with the obstacle.

After the collision, Mr. Chung’s 2022 Honda City car was severely damaged. The airbags inside were deployed, the front part of the car was broken, the wheels were pushed backward, the wheel rims were broken, the axles were broken, the suspension system was damaged… Immediately after that, he called the expressway management unit for assistance. The car was then towed to a Honda dealer in Ninh Binh for inspection, and the estimated repair cost is about 70 million VND.

The obstacle was not randomly appeared

Mr. Chung said that after the accident, he got out of the car to inspect it and discovered that the obstacle looked like a very large package, wrapped in layers of cloth and with the recipient’s address on the outside. Inside was a pink-colored amethyst stone slab with dimensions of about 30×40 cm and weighing about 100 kg. He also said that after the accident, he noticed a truck parked not far away from the emergency lane for about 2 minutes and then left. Therefore, he speculated that this truck dropped the obstacle onto the expressway, causing his car to have an accident.

The parties involved do not admit responsibility

Immediately after, Mr. Chung contacted the phone number written on the layers of cloth and got a number for the transportation company. When he called, it was confirmed that it was his shipment, but the transportation was by G.H. Logistics. After learning about the story, both parties promised to investigate and contact Mr. Chung to resolve the issue, but “disappeared” since then.

Upset about the incident, Mr. Chung contacted the media to put pressure on the transportation company. However, the response from G.H. Logistics surprised the Honda City owner even more as they claimed no responsibility. The company even blamed Mr. Chung’s poor driving skills for the incident.

At this point, Mr. Chung decided not to negotiate anymore and contacted law enforcement agencies to claim his rights. He said everything is still being resolved.

The legal regulations

According to Article 20 of Decree 46/2016/ND-CP on administrative violations in the field of road traffic, rail traffic, vehicle operators, tractors, and similar vehicles to cars violating regulations on environmental protection when participating in traffic will be punished as follows:

1. Warning or a fine of between 50,000 VND and 100,000 VND for the act of driving a vehicle without meeting the cleanliness requirements in urban areas.

2. A fine of between 1,000,000 VND and 3,000,000 VND for one of the following violations:

a) Dropping lubricants, chemicals on the road;

b) Carrying loose cargo, waste, construction materials that can easily fall without having a cover or having a cover but still allowing them to fall; carrying goods or waste causing water to flow onto the road, affecting traffic safety and environmental sanitation;

c) Dragging mud, dirt, sand, raw materials, materials, or other waste onto the road, affecting traffic safety and environmental sanitation.

3. A fine of between 4,000,000 VND and 6,000,000 VND for the driver of a vehicle illegally dumping garbage, soil, sand, rocks, materials, waste within the land area reserved for roads outside urban areas.

4. A fine of between 10,000,000 VND and 15,000,000 VND for the driver of a vehicle performing the act of illegally dumping garbage, soil, sand, rocks, materials, waste onto the street.

5. In addition to being fined, the vehicle operator committing violations under Clause 3 and Clause 4 of this Article shall also be subject to the additional penalty of revocation of the driver’s license for a period of 01 to 03 months.

6. In addition to being subject to penalties, the vehicle operator committing violations under Clause 1, Clause 2, Clause 3, and Clause 4 of this Article shall also be subject to the measures to remedy the consequences: Obligation to remediate the violations, clean up materials, garbage, waste, and restore the originally altered state caused by administrative violations; in case of environmental pollution, they must take measures to remedy the pollution.
