Recently, the Ho Chi Minh City Department of Transport has proposed to the Ministry of Transport a pilot project on centralized training on digital platforms and management systems for driving training in category B (B1, B2), C.
The purpose of the proposal is to implement a pilot project on training driving in category B1, B2, C with theoretical part based on a digital centralized learning model, self-study with guidance and supervision through software and digital technologies.
The Ho Chi Minh City Department of Transport analyzed that currently there are inconsistencies in the form of theoretical training that is regulated in the Vocational Education Law and the Road Traffic Law of 2008.
Specifically, the Vocational Education Law allows the form of training to work while studying or self-study with guided and supervised time, methods, and training locations that are suitable for the learners’ requirements. However, driving training according to the Road Traffic Law of 2008 can only be conducted in a centralized form at training establishments.
Therefore, if driving training establishments build programs using distance learning or self-study with guided learning methods according to the regulations of the Vocational Education Law, it would contradict the regulations regarding centralized training at driving training establishments according to the Road Traffic Law.
However, the 2015 Law on Promulgation of Legal Normative Documents stipulates that if legal normative documents issued by the same authority have different regulations on the same issue, the regulation of the document issued later will be applied.
Therefore, the driving training programs for drivers who need to obtain category B2, C, D, E driving licenses and category F driving licenses will be carried out through distance learning or self-study with guided learning methods according to the regulations of the Vocational Education Law.
According to the Ho Chi Minh City Department of Transport, to enhance the effectiveness of state management, improve the quality of training, examination, and management of driving licenses, the digitization of driving training should be implemented.
This is to create favorable conditions for people to arrange their study time flexibly and in line with the digital transformation trends of the world.
This project is considered feasible and highly effective. It also partly meets the legitimate needs of learners as they can self-study anytime, anywhere, save costs, and have flexible schedules.
“During the waiting time for amending the Road Traffic Law and other relevant regulations, the Ho Chi Minh City Department of Transport recommends the Ministry of Transport to provide opinions for implementation. At the same time, consider resolving the pilot project proposal (if any) of other driving training establishments to avoid monopoly situations,” the Department of Transport recommends.
