Recently, the Ministry of Public Security has proposed regulations on points and deduction of driving licenses for drivers who violate the draft Law on Order and Road Traffic Safety.
The Ministry of Public Security has just drafted a report to the National Assembly, explaining some contents of the draft Law on Order and Road Traffic Safety for the opinions of National Assembly deputies at the 6th session. Notably, the Ministry of Public Security proposed to supplement the regulation on deducting points from driving licenses.
In the document sent to agencies and associations for opinions on some new contents in the draft Law on Order and Road Traffic Safety, the Ministry of Public Security stated that the regulation on points and deduction of driving licenses as in the draft is necessary.
According to this agency, the management of drivers after passing the test and obtaining a driving license is loosening, the competent authorities do not have appropriate management measures, especially in terms of drivers’ compliance with the law. Advanced countries such as Singapore, Japan, and China all have regulations on deducting points from driving licenses for violators, posing a risk to traffic safety.
Deducting points from driving licenses is also similar to state management regulations in fields such as health and pharmacy. The law stipulates administrative management measures similar to revoking professional certificates. “This will be a state management measure, not an administrative penalty for violations, meeting the practical requirements of maintaining order and traffic safety,” the Ministry of Public Security said.
This measure helps to manage drivers throughout the process from training, testing, and granting driving licenses to the process of law enforcement, recidivism. Deducting points from driving licenses also aims to improve conduct, raise awareness, and help comprehensive management by authorities of the process of post-violation behavior of drivers.
In the draft, the Ministry of Public Security states that the government will issue specific regulations on authority, basis, procedures, implementation of points deduction, and restoration of driving licenses. Procedures for points deduction and restoration will ensure simplicity, reasonableness, and avoid inconvenience for violators, by applying information technology, digitizing the database of testing and granting driving licenses; the database of administrative penalties for violations.
When there is a decision on a penalty (for an offense with a point deduction regulation), the driver will receive a notification from the penalizing authority. The database system will automatically deduct the points (without contact between the authorized person and the violator, so there will be no negative consequences, no overlap with forms of administrative penalties for violations) or restore the points for the driver after 1 year from the last deduction, if there are still points remaining in the system.
