Vietnam Passes Law to Implement Toll Fees for State-Invested Highways
On the morning of June 27, 2024, the National Assembly passed the Road Law, which includes provisions for toll fees for vehicles entering state-invested highways.
Specifically, Article 50 of the Road Law stipulates the collection of toll fees for the use of state-owned highways under the management of the State, including highways invested in by the State and those transferred to the State for management. The collected fees will be submitted to the state budget and invested in the maintenance, repair, and upgrade of highway routes.
The government will elaborate on the conditions and timing of toll fee collection for highway use. Organizations receiving toll collection rights and business concessions will also have to pay the collected money into the state budget. Only the revenue during the contract implementation period is exempt from the state budget, except for the revenue share that must be shared with the State.
According to the National Defense and Security Committee, toll fee collection for state-invested highways does not lead to “double charging” as road users can opt to use the parallel national highways free of charge.
Previously, the Ministry of Transport had proposed toll fee collection for cars entering some highways invested by the State. The Ministry planned to collect fees on 9 highways over 5 years.
According to the Ministry of Transport, the toll fee rates will adhere to principles such as suitability to the interests and payment capacity of users. After offsetting organizational costs, the remaining funds will be contributed to the state budget. Revenue from highways invested with state capital will be returned to the state budget and prioritized for investment in the management and maintenance of road infrastructure.
The Law on Roads includes a chapter on expressways with 12 articles. In addition, the Law dedicates a chapter to regulating road transport, outlining the rights and obligations of transport business units, drivers, and attendants on cars.
The Road Law will officially take effect from January 1, 2025. It is one of two laws separated from the Law on Traffic and Road Safety, the other being the Law on Order and Traffic Safety.
