The President’s Office has recently announced new laws passed by the National Assembly during its 7th session, including the Law on Road Traffic Order and Safety, which is expected to take effect from January 1, 2025.

The Law on Road Traffic Order and Safety introduces a brand new regulation: Deducting points from the Driver’s License. Accordingly, Article 58 of this Law stipulates: The points of the driver’s license are used to manage the compliance with the law on road traffic order and safety of the driver, consisting of 12 points. The number of points deducted for each violation depends on the nature and severity of the offense.

Data on the deducted points from the driver’s license of the offender will be updated in the database system immediately after the penalty decision takes effect.

If, within 12 months from the last deduction, the driver does not commit any other violation, the driver’s license will be restored to its full 12 points.

If all points are deducted, that person is temporarily not allowed to drive a road vehicle according to the type of license that has been deducted.

When all points are deducted from their driver’s license, individuals must undergo a review of their knowledge of road traffic order and safety regulations to have their 12 points reinstated. The Ministry of Public Security will issue a circular providing specific guidance on this matter.

The entire process of deducting points from a driver’s license will be fully automated, ensuring no inappropriate human intervention in accordance with the law, thus bringing transparency and fairness to law enforcement.

To facilitate the implementation of deducting points from driver’s licenses and avoid causing inconvenience to the public and confusion in execution, the Ministry of Public Security is building a database on administrative penalties in general, including those related to road traffic.

According to Deputy Minister Le Quoc Hung, as up to 85% of administrative penalty decisions fall under the authority of the Ministry of Public Security, the development of this database is of great importance.

Once the database system is completed, it will support interconnected and shared information, thereby enabling easy identification and retrieval of citizens’ violations at any time.
