Vietnam’s Ministry of Public Security seeks feedback on a draft decree proposing administrative penalties for road traffic order and safety violations.
The draft decree outlines cases where, in addition to fines, vehicles may be confiscated corresponding to the driver’s actions.
The feedback period for the draft is planned to end on October 1, 2024.
Circumstances for confiscating automobiles
The draft stipulates that automobiles (including towed or pulled trailers) and automobile-like vehicles, passenger vehicles, and four-wheeled cargo vehicles with engines will be confiscated if:
The driver operates a vehicle (including trailers) beyond its permitted usage period.
The vehicle has been illegally manufactured or assembled (including agricultural vehicles that are prohibited from participating in traffic, as well as towed or pulled trailers).
These actions will result in vehicle confiscation, except for commercial passenger vehicles with a capacity of 10 seats or more that have exceeded the stipulated usage period for their registered business type but are not older than 20 years from the manufacturing year; and passenger vehicles with fewer than 10 seats engaged in passenger transportation.
Driving a vehicle without a valid registration certificate or using an expired registration certificate (including trailers) will also result in confiscation.
Additionally, if the above actions are committed without a registration certificate or with an invalid one that does not match the vehicle’s frame and engine numbers or has been tampered with (including trailers), and the driver cannot provide proof of the vehicle’s origin (lacking valid ownership transfer documents or legal origin papers), the vehicle will be confiscated.
According to the draft, vehicle confiscation will also occur when an automobile is driven in an illegal race on a traffic route (excluding animal-drawn or ridden vehicles)…
Instances for confiscating motorcycles
As per the draft, motorcycle riders will have their vehicles confiscated if they repeatedly or frequently engage in the following behaviors: Releasing both hands from the handlebars while driving, steering with their feet, sitting or lying sideways on the seat, switching drivers while the vehicle is in motion, turning around to face backward while driving, or driving with their eyes covered.
Weaving or swerving on the road within and outside urban areas. Riding on one wheel with a two-wheeled motorcycle, or on two wheels with a three-wheeled motorcycle. Riding in a group of two or more motorcycles and exceeding the speed limit.
If the above actions are committed without a valid registration certificate or with an invalid certificate that does not match the vehicle’s frame and engine numbers or has been tampered with, the motorcycle will be confiscated.
Additionally, bicycle, motorized bicycle, and other non-motorized vehicle riders will have their vehicles confiscated if they repeatedly or frequently engage in the following behaviors: Weaving, swerving, or chasing each other on the road; riding on one wheel with a bicycle or motorized bicycle, or riding on two wheels with a pedicab.
