Starting January 1st, 2025, the new Road Traffic Safety and Order Law will come into force, introducing changes to the rules for motorcycles and scooters. Specifically, the law outlines the circumstances under which these vehicles are allowed to carry a maximum of two people.

According to Clause 1, Article 33 of the 2024 Law, drivers of motorcycles and scooters are generally only allowed to carry one passenger. However, there are exceptions to this rule, and in the following cases, they can carry up to two passengers:
– Transporting an injured person to a medical facility for emergency treatment (consistent with the current law)
– Transporting a person who is being apprehended for breaking the law (also consistent with the current law)
– Carrying a child under 12 years old (a reduction of 2 years compared to the current law)
– Accommodating the elderly or people with disabilities (a new addition to the law)
So, in the above situations, riding three on a motorcycle or scooter won’t result in a fine from the authorities. However, according to Decree 100/2019/ND-CP and Decree 123/2021/ND-CP, if a driver carries more passengers than allowed, they will be subject to fines. The penalties are as follows:
– Carrying two people: a fine of 300,000 to 400,000 VND
– Carrying three or more people: a fine of 400,000 to 600,000 VND
Furthermore, if an accident occurs due to overloading, the violator will have their driver’s license revoked for a period of 2 to 4 months.
The 2024 Road Traffic Safety and Order Law also introduces several other changes, including a new driver’s license classification system, mandatory emissions testing for motorcycles, stricter rules for children under 10 years old riding in cars, a complete ban on driving under the influence of alcohol, a point-based driver’s license system, regulations for school buses, and the introduction of auctions for motorcycle license plates.
