Under the latest regulations stipulated in Decree 168/2024/ND-CP, candidates taking the driving test may be fined up to VND 10 million if they bring a mobile phone into the testing room.

Article 39, Clause 3 of Decree 168/2024/ND-CP sets out fines ranging from VND 5,000,000 to VND 10,000,000 for one of the following violations:

Driving schools that fail to assign an instructor to sit next to the student during practical driving lessons or assign unqualified instructors;

Driving schools that use training vehicles without a valid training vehicle permit, or with an expired one, or fail to display the “Training Vehicle” sign on the vehicle as prescribed, or do not provide the school’s name and phone number on the outside of both sides of the vehicle’s doors or body as required;

Driving schools that use training vehicles without an additional auxiliary braking system or have one that is non-functional; Driving schools that enroll students who do not meet the minimum educational requirements, safe driving time corresponding to each training level, or fail to provide a complete set of student records as mandated;

Driving schools that do not have enough practical driving instructors for the number of training vehicles used; Driving schools that fail to store or do not fully store records as required for a training course;

Driving test centers that fail to maintain the conditions specified in the National Technical Regulations on Driving Test Centers for Road Motor Vehicles, except for violations prescribed in Clauses 4, 5, and 7 of Article 39 of Decree 168/2024/ND-CP; Driving test centers that fail to store or do not fully store records as required for a driving test session;

Individuals who use false documents to enroll in learning, testing, or obtaining a new or renewed driver’s license, or a certificate of legal knowledge enhancement in road traffic, without incurring criminal liability;

Candidates taking the driving test who bring mobile phones, telecommunication devices capable of audio or visual communication into the theory test room, driving simulation room, or testing vehicle, or engage in other dishonest acts that may affect the test results.

In cases where a traffic order and safety violation in the field of road traffic occurs and concludes before Decree 168/2024/ND-CP takes effect (January 1, 2025) and is discovered or under consideration for resolution afterward, the decree in force at the time of the violation shall be applied.

If the violation is ongoing, the decree in force at the time of the discovery shall be applied.
