Decree 168/2024/ND-CP on administrative sanctions for traffic order and safety violations in the field of road traffic will come into force in 2025.

The Decree has supplemented and amended a number of regulations for citizens when traveling on the road.

Specifically, when participating in traffic, citizens need to carry the following types of documents:

According to Clause 1, Article 56 of the 2024 Law on Road Traffic Order and Safety, drivers participating in road traffic must meet the age and health requirements prescribed by law; have a valid driver’s license with points, which is appropriate for the type of vehicle being driven and issued by a competent authority, except for motorcycle drivers. When participating in road traffic, drivers must carry the following documents:

Vehicle registration certificate or certified true copy of the Vehicle Registration Certificate together with the original of the confirmation document of a credit institution or foreign bank branch, which is still valid in case the vehicle is mortgaged at a credit institution or foreign bank branch;

Driver’s license appropriate to the type of vehicle being driven;

Certificate of technical safety inspection and environmental protection for motor vehicles as prescribed by law;

Compulsory civil liability insurance certificate for motor vehicle owners.

In case the papers have been integrated into the electronic identity account (VNeID), the presentation and inspection can be done through the electronic identity account.

In case of not carrying a driver’s license, the following penalties will be applied:

For motorcycles:

According to Point d, Clause 2, Article 18 of Decree 168/2024/ND-CP, those who drive motorbikes and similar types of motorbikes for transport business without carrying a driver’s license shall be fined from 200,000 VND to 300,000 VND.

For cars:

Those who drive cars, four-wheeled passenger cars with engines, four-wheeled cargo vehicles with engines, and car-like vehicles for transport business without carrying a driver’s license shall be fined from 300,000 VND to 400,000 VND.

In case of not having a driver’s license and still traveling on the road, the following penalties will be applied:

For motorcycles

Those who drive a two-wheeled motorcycle with a cylinder capacity of up to 125 cm3 or an electric motor with a capacity of up to 11 kW, and a motorcycle-like vehicle without a driver’s license, shall be fined from 2,000,000 VND to 4,000,000 VND.

Those who drive a two-wheeled motorcycle with a cylinder capacity of over 125 cm3 or an electric motor with a capacity of over 11 kW, or a three-wheeled motorcycle without a driver’s license, shall be fined from 6,000,000 VND to 8,00,000 VND.

For cars

Those who drive cars and car-like vehicles, four-wheeled passenger vehicles with engines, and four-wheeled cargo vehicles with engines without a driver’s license shall be fined from 18,000,000 VND to 20,000,000 VND.
