Many readers have called the “ANTĐ Hotline” to ask if the owner of a vehicle who sells the car but does not complete the procedure to retrieve the registration certificate and license plate will be subject to penalties. What is the maximum fine?

Regarding the above issue, according to the representative of the Traffic Police Department, when selling a car, the owner must retain the vehicle registration certificate and license plate (not hand them over to the organization or individual receiving the transferred ownership) and submit them to the vehicle registration and license plate authority to complete the retrieval procedure. In the case of transferring ownership of the vehicle along with the auctioned license plate, the owner shall submit the vehicle registration certificate to the vehicle registration authority to complete the retrieval procedure.

Within 30 days from the date of issuing the vehicle transfer documents, the owner must complete the retrieval procedure. If the owner fails to do so within this period or hands over the vehicle registration certificate and license plate to the organization or individual receiving the transferred ownership to complete the retrieval procedure, the vehicle registration authority shall issue a decision to fine the owner for the act of failing to retrieve the documents before processing the request.

In terms of penalties, according to Clause 7, Article 30 of Decree 100/2019/ND-CP, amended by Decree 123/2021/ND-CP, on sanctioning owners of means of transport violating road traffic regulations, a fine of VND 800,000 – VND 2 million shall be imposed on individuals, and VND 1.6 million – VND 4 million on organizations that are owners of motorcycles, scooters, and similar vehicles, for committing one of the following violations:

Failure to comply with the retrieval of vehicle registration certificates and license plates as prescribed; Installation and use of devices that alter the license plate number contrary to regulations…

A fine of VND 2 million – VND 4 million shall be imposed on individuals, and VND 4 million – VND 8 million on organizations that are owners of automobiles, tractors, specialized motor vehicles, and vehicles similar to automobiles, for committing one of the following violations:

Failure to comply with the retrieval of vehicle registration certificates and license plates as prescribed; Failure to comply with the retrieval of the Certificate of Inspection for Traffic Safety and Environmental Protection of Road Motor Vehicles…

Thus, when selling a vehicle, the owner who fails to retrieve the vehicle registration certificate and license plate may be subject to administrative penalties as follows:

For owners of motorcycles, scooters, and similar vehicles who do not comply with the retrieval of vehicle registration certificates and license plates as prescribed, a fine of VND 800,000 – VND 2 million shall be imposed on individuals, and VND 1.6 million – VND 4 million on organizations.

For owners of automobiles, tractors, etc., who do not comply with the retrieval of vehicle registration certificates and license plates as prescribed, a fine of VND 2 million – VND 4 million shall be imposed on individuals, and VND 4 million – VND 8 million on organizations.

Regarding the above regulations, Mr. Le Dinh Lan, from Kim Ma Ward, Ba Dinh District, Hanoi, expressed his concern: “According to Article 23 of Circular 24/2023/TT-BCA, one of the cases for the retrieval of vehicle registration certificates and license plates is when the vehicle undergoes registration transfer or relocation. So, if the owner does not retrieve the documents after transferring the ownership, will he/she be held responsible for any violations related to that vehicle? Where should the owner go to complete the retrieval procedure for the registration certificate and license plate?”

According to current regulations, if the owner fails to retrieve the vehicle registration certificate and license plate after selling the vehicle, he/she shall be held responsible before the law for any violations related to that vehicle.

The owner must go to the vehicle registration and license plate issuance authority to complete the retrieval procedure. After receiving and checking the valid documents, the vehicle registration authority shall issue a certificate of retrieval of vehicle registration and license plate according to regulations; one copy shall be given to the owner, and one copy shall be kept in the vehicle file. The owner can receive the result directly from the vehicle registration authority or through the public postal service.
