Are Ambulance Drivers Exempt From Traffic Violation Penalties?
Are ambulance drivers, who are on emergency duty and thus given traffic priority, exempt from penalties if they violate road safety regulations while on duty?
According to Article 27 of the Law on Order and Traffic Safety 2024, the order of priority vehicles is as follows: Priority vehicles include fire trucks of the Police for Fire Prevention, Firefighting, and Rescue, and fire trucks of other forces mobilized for firefighting duties; vehicles of the military, police, and inspection forces on emergency missions; convoys with traffic police escorts; ambulances on emergency duty; dyke protection vehicles on duty; vehicles on duty for rescue, rescue, natural disaster response, or epidemic prevention, or vehicles on emergency duty as prescribed by law; and funeral processions.
Priority vehicles have the right-of-way over other vehicles when approaching an intersection from any direction, following the order of priority from top to bottom as follows:
– Fire trucks of the Police for Fire Prevention, Firefighting, and Rescue, and fire trucks of other forces mobilized for firefighting duties.
– Vehicles of the military, police, and inspection forces on emergency missions; convoys with traffic police escorts.
– Ambulances on emergency duty; Dyke protection vehicles on duty; vehicles on duty for rescue, rescue, natural disaster response, or epidemic prevention, or vehicles on emergency duty as prescribed by law; Funeral processions.
Regarding the penalties for driving violations, Article 30 of Decree 168/2024/ND-CP on sanctions and point deductions from the driver’s licenses of ambulance drivers is very clear: A fine of VND 1,000,000 to VND 2,000,000 will be imposed for the violation of driving an ambulance without installing a device to record the driver’s image or having such a device installed but non-functional during the vehicle’s participation in traffic, or for manipulating the data of the driver’s image recording device installed in the car.
A fine ranging from VND 3,000,000 to VND 5,000,000 will be imposed for the violation of driving an ambulance without installing a journey supervision device or having such a device installed but non-functional during the vehicle’s participation in traffic, or for manipulating the data of the journey supervision device installed in the car.
In addition to the fines, the driver will also have 2 points deducted from their driving license for the above violations.
