Commercial Vehicles Must Be Equipped with Seat Belts or Child Seats

According to Decree 168/2024 on road traffic violations, from January 1, 2026, commercial vehicles transporting preschool and primary school children must be equipped with age-appropriate seat belts or child seats. Failure to comply will result in a fine of VND 3-4 million for individuals and VND 6-8 million for organizations. Drivers operating vehicles without proper safety restraints for children will face a penalty of VND 1-2 million.

Children Under 10 Prohibited from Sitting in the Front Seat

Under Law 118/2025 amending 10 laws related to security and order, effective July 1, 2026, children under 10 years old and shorter than 1.35 meters are prohibited from sitting in the front row (except in single-row vehicles). Drivers must ensure children use appropriate safety devices such as seat belts or child seats. Violators will be fined VND 800,000–1,000,000. This regulation does not apply to commercial passenger transport vehicles.

From July 1, 2026, vehicles must be fitted with child seats.

Initially, this regulation was scheduled to take effect from January 1, 2026. However, the implementation date was postponed by six months to allow individuals and businesses adequate preparation time.

Regulations on Daily Driving Hours

Also under Law 118/2025, the rule limiting commercial vehicle drivers to a maximum of 10 driving hours per day will be repealed from July 1, 2026. Instead, drivers’ working hours will align with the Labor Code: no more than 8 hours daily or 48 hours weekly. Drivers may drive up to 10 hours on one day but must reduce hours on other days to stay within the weekly limit.

Meanwhile, the rule prohibiting drivers from driving continuously for more than 4 hours remains in effect to minimize fatigue-related safety risks.

Regulations on Bus Drivers Transitioning to Container Truck Driving

Law 118/2025 expands eligibility for upgrading driver’s licenses to class CE in 2026. Class CE licenses permit driving class C vehicles towing trailers over 750 kg or tractor-trailers.

From July 1, 2026, in addition to class C license holders, individuals with class D1, D2, and D licenses can undergo training to upgrade to class CE. This enables bus and passenger vehicle drivers holding class D licenses to shorten their training period when transitioning to driving tractor-trailers or container trucks.
